Terms & Conditions

By using the OfficeNational Cairns www.oncairns.com.au or ebuy.oncairns.com.au sites (the Sites) the Customer agrees that the following Terms and Conditions of use will apply:

The OfficeNational Cairns www.oncairns.com.au and ebuy.oncairns.com.au sites is provided by: OfficeNational Cairns ABN 21 009 983 126, at 27 Oleary Street, (PO Box 1112) Cairns, QLD 4870 (herein identified as ONC and or OfficeNational Cairns)

This agreement contains the limited warranty and terms and conditions applicable to all OfficeNational Cairns products such as Personal Computer Systems, Notebooks, Servers, Components and Services. Please be certain to read the individual warranties for accessories contained in the shipping detail. You agree that this agreement applies to your purchase of the product, accessories and services after your limited guarantee expires, the remaining provisions of this agreement will continue to apply as stated under.

The information and statements under the links for Privacy & Security and, Legal Information, also form part of these terms and conditions.

1. Governing Law
This Agreement is governed by the laws of the State of Queensland and each party, unconditionally and irrevocably submits to the non-exclusive jurisdiction of the Courts of the State of Queensland.

2. Revisions of Terms of Use
Each order is governed by the terms and conditions current when the order is placed. OfficeNational Cairns may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.
You agree that, in the event that any portion of these Terms of Use is found to be unenforceable, the remainder of these Terms of Use remain in full force and effect and any revisions will be effective immediately.

3. Prohibited Conduct
No trade mark (whether registered or otherwise) that is contained on this site or otherwise used by OfficeNational Cairns may be used without our prior, specific, written permission or that of the trademark owner.

4. Privacy and Security
No information provided to OfficeNational Cairns will be given to any other organisation other than is necessary to complete the delivery of your order. You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify OfficeNational Cairns in connection with any use (whether authorised or unauthorised) of your user name or password. OfficeNational Cairns may suspend or cancel your account at any time without prior notice.

5. Pictures & Images
OfficeNational Cairns aims to include up-to-date pictures of all of the goods on this web site. However, our picture of the goods may differ from the actual goods. We recommend you read the labels on the goods carefully before using the goods.

6. Price and currency
All prices and transactions are in Australian Dollars.
Customers are advised that our prices are updated daily, and are denoted on the website with the product. This is the final price at the time of purchase. We will not make a price adjustment should an order have already been shipped. Please note that Promotional price may not be applied after an order is placed. To cancel an order you may call in, and send an email to ensure the transaction is documented. Please note that the order cannot be cancelled without credit return authorisation number. Shipping costs are not refundable.

For each order, you must pay the applicable price for the relevant goods and the delivery and handling fee specified on the web site or as quoted.

OfficeNational Cairns may vary prices in the event of price changes or mistakes made by suppliers on reasonable prior notice to you. If OfficeNational Cairns requests payment for increased prices, you may cancel the order by giving notice to OfficeNational Cairns , which must be received within seven days of the announcement of the increase.

7. Orders
All orders placed through this web site are subject to confirmation and acceptance by OfficeNational Cairns.

8. Delivery
When placing an order with us, where we are to deliver goods to you, we require a physical street address. To assist us in processing your order, please provide your land-line phone number. Delivery is via courier and cannot be to a Post Office Box. Please note that an authorised signatory needs to be at the delivery address to sign for and collect the goods, and that photo identification may be requested.

OfficeNational Cairns or its agent will deliver the goods you order to the address you specify in your order, within a time frame subject to their availability. Where the goods are not available you will be notified of this by OfficeNational Cairns as soon as possible. Anyone at the delivery address who receives the goods will be presumed by OfficeNational Cairns to be authorised to receive the goods.

If there is no-one at the delivery address or no-one of appropriate age to receive and where necessary pay for the order, OfficeNational Cairns may charge you additional delivery fees.

Once the goods are delivered to you, it is your responsibility if they are lost or damaged.

9. Limitation on Damages.
The Customer acknowledges and agrees that OfficeNational Cairns and its agents, directors or employees (OfficeNational Cairns Staff), will not be liable to the Customer for any actions, claims, damages, liabilities, costs, expenses, or losses in any way arising out of or relating to the Products or Services provided. This clause applies regardless of the form of action, damage, claim, liability, cost, expense, or loss, whether in contract, statute, tort (including, without limitation, negligence), or otherwise.

10. Limitation on Warranties.
OfficeNational Cairns disclaims all other warranties, either express or implied, including without limitation warranties of merchantability and fitness for a particular purpose. This site and its contents are provided on an 'as is' basis and use of this site is at your own risk. Where any legislation such as the Trade Practices Act (1974) (Cwth) implies into this Agreement any condition or warranty and that legislation voids or prohibits conditions in a contract excluding the application of the condition or warranty, the liability of OfficeNational Cairns for any breach of the condition or warranty is limited to in the case of goods to (i) the replacement of or the supply of equivalent goods; or (ii) the repair of any defect in the goods.
Rights We Cannot Exclude: The above disclaimer and liability limitation do not exclude any rights, which by law may not be excluded, including but not limited to your rights under the Trade Practices Act.

11. When You Order Products or Services
You agree to pay the full amount for the products and/or services provided by OfficeNational Cairns and the costs associated with delivery to your nominated address. Unless specifically requested all products will be shipped without insurance and OfficeNational Cairns reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, errors or omissions in the price or the product description posted on this site, or an error in your order. We only accept web site orders from Australia.

12. Purchasing and Payment
For online orders we accept payment by Visa, MasterCard & BankCard. A Credit Card processing fee of 1.65% of the total Invoice value applies to all Credit Card Paymants. We do not accept COD deliveries.

Your order and credit card details are safe and secure. OfficeNational Cairns uses SecurePay's Internet payment service gateway to provide a secure environment for the authorisation of credit card transactions over the Internet. All personal and credit card information provided to OfficeNational Cairns is also encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet.

13. Collection of Goods from OfficeNational Cairns
Products may be collected from the OfficeNational Cairns warehouse in Cairns, Queensland. In some cases delivery charges may still apply as goods are sourced from manufacturers throughout Australia.

14. Title & Risk
Title to the goods purchased on this site does not pass from OfficeNational Cairns to you until we have received full and cleared payment for the goods. All risk in the goods passes to you upon delivery.

15. Liability
Any liability of OfficeNational Cairns in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of OfficeNational Cairns be limited to:

  • in relation to goods, the replacement of the goods or the supply of equivalent goods; and
  • in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

16. Your Login & Account Details
It is the responsibility of the customer to protect and authorise the use of user names and passwords. OfficeNational Cairns will not take responsibility for customer user names and password protection. Both account & COD customers are liable to pay all monies outstanding from the purchase of goods on their account by any person that used their user name or password. You agree to release and indemnify OfficeNational Cairns in connection with any use (whether authorised or unauthorised) of your user name or password. OfficeNational Cairns may suspend or cancel your account at any time without prior notice.

17. Return, Refunds & Credit of Goods
No returns will be accepted after 7 days from invoice date, other than DOA products.

No returns will be accepted if goods have been opened and/or used.

Product supplied on a "No Return" basis can not be returned to OfficeNational Cairns unless the product is faulty within the warranties imposed by statue and which cannot be excluded by agreement.

Product sold on the "No Returns" basis:

  • All Compaq products
  • All Diamond OEM products
  • All EPSON Products
  • All Fujitsu Hard Drives
  • Hewlett-Packard PC, server and notebook products, including accessories
  • All Hewlett-Packard UNIX products
  • All Honeywell OEM products
  • All IBM hardware products
  • All Intel CPUs, Overdrives, graphics cards and motherboard products
  • All Iomega OEM products
  • All Microsoft OEM products
  • All Quantum Hard Drives
  • All Storagetek products
  • All Toshiba Products
  • All products supplied where the Site states that the product is sold on a No Return Basis.
  • All products supplied under this condition will have "No Return" clearly marked on the OfficeNational Cairns invoice.

At its sole discretion, OfficeNational Cairns may decide to allow a return of a product that in its view is a fast moving item. In that case, returns for credit or exchange will be subjected to a 15% restocking fee and must be completed within 21 days from the invoice date.

If the product is not faulty, Steps 1 through 3 below may apply.
If the product is faulty, Steps 1 through 4 below apply, subject to the "Restrictions Imposed by Manufacturers" below.

Step 1 : Should you wish to return any product, OfficeNational Cairns must be notified in writing, either by fax or e-mail advising the date of purchase, invoice number and the serial number of the product. Once the OfficeNational Cairns representative has identified the product, if a decision to allow a return is made, a Return Authorisation (RA) number will be issued.

Step 2 : The RA number should be clearly written on a sticky label placed on the outside of the shipping carton - do not write directly on the carton. If the RA number cannot be identified the product will be returned immediately at the buyer's expense.

Step 3 : OfficeNational Cairns will supply you with the return address upon receipt of return authorisation number. OfficeNational Cairns recommends that product returned by post should be sent by registered or certified mail, at buyers expense. OfficeNational Cairns accepts no responsibility for loss or damage occurring in transit.

Step 4 : OfficeNational Cairns will endeavour to have your product repaired or replaced within 7 working days of its receipt, (exceptions to this may occur from time to time).

Restrictions Imposed by Manufacturers
Hewlett-Packard
If the product fails within 30 days of it being invoiced to the final user of the product then it is considered to be Dead On Arrival (DOA). In this case please contact OfficeNational Cairns . If the product failure occurs outside this 30 day period it is considered to be a standard warranty call. In this case, the final purchaser of the product should contact Hewlett-Packard Customer Service on the phone warranty service call.

Netcomm/Avtek
Any product which arrives damaged or fails shortly after sale to an end user is considered DOA. If the unit is complete and in original packaging, OfficeNational Cairns can organise a replacement if contacted within 14 days of purchase or 21 days of sale to the end user. To organise a replacement under this scheme, contact OfficeNational Cairns (you may be required to forward a copy of you purchase invoice and/or the end users' purchase docket). For incomplete products or DOAs which fall outside the above parameters, warranty repairs, upgrades and replacements contact NetComm/Avtek Customer Care on (02) 9424 2055.

OKI/Mustek DOA
Any OKI/Mustek product that fails within 7 days of purchase by the end user, is considered to be DOA. Resellers are required to call IPL Datron on (02) 9698 08211 to arrange consultation with IPL Service Dept. Once the fault is verified, IPL will issue an approval number which must then be given to the OfficeNational Cairns Returns Department, who will issue an RA.

Sony
Repair on Sony products should be referred to the local Sony Service centre or authorised agent. Sony monitors are covered by a 3 year warranty, Sony floppy drives by a 2 year warranty and all other hardware products by a 12 month warranty.
Return & Credit of Goods

18. Termination
Your ability to purchase goods from this site may be terminated by OfficeNational Cairns at any time without notice. All restrictions, licences granted by you and limitations of OfficeNational Cairns liability will survive termination. If you breach any of the above provisions, OfficeNational Cairns reserves the right to prohibit you immediately from accessing the Website at any time.

19. Privacy
At OfficeNational Cairns we respect your privacy.

OfficeNational Cairns complies with the National Privacy Principles and the Privacy Act 1998 (Cth). Any and all information collected at this site will be kept strictly confidential and will not be sold, rented, loaned, or otherwise voluntarily disclosed to any person or company except for the purposes of fulfilling your order. The information we collect will be used to process your order and billing. This information will be disclosed to our Service Providers who do something on our behalf (eg mailing house, data processor, courier, wholesale supplier, manufacturer, distributor) and/or other members of the Ireland's Group. If you do not provide information to us as requested, we may not be able to process your application. You can access the personal information we have collected, if we have retained it, by contacting us via email info@oncairns.com.au and addressing your request in the email to The Privacy Officer.

20. Your Acceptance of These Terms
By using the OfficeNational Cairns web site, you signify your agreement with the OfficeNational Cairns Terms & Conditions & Privacy Statement. If you are NOT able to agree with any aspect of this policy, please do not use the OfficeNational Cairns site.
